Terms of Service

1. Introduction

Welcome to Recoil Gang. These Terms of Service ("Terms") govern your access to and use of the Recoil Gang software, website, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you do not have permission to access or use the Service.

We reserve the right to modify these Terms at any time without prior notice. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

2. Definitions

"Software" refers to the Recoil Gang application and all its components.

"License Key" refers to the unique activation code provided upon purchase.

"HWID" (Hardware ID) refers to the unique identifier associated with your hardware configuration.

"User", "You", and "Your" refer to the individual or entity that has agreed to these Terms.

"We", "Us", and "Our" refer to Recoil Gang.

3. License and Use Restrictions

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Software for your personal use only. The license is valid for the period specified at the time of purchase.

3.2 Usage Limitations:

Your License Key is bound to your HWID upon first activation. The License Key can only be used on one device at a time. If you need to transfer your license to a new device, you must first reset your HWID through your account dashboard.

HWID resets are limited and excessive reset requests may result in account suspension.

4. Intellectual Property

The Software, including all content, features, and functionality, is and will remain the exclusive property of Recoil Gang and its licensors. The Software is protected by copyright, trademark, and other laws of both the United States and foreign countries.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Recoil Gang.

5. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will function uninterrupted, secure, or available at any particular time or location, or that it will be free of errors, defects, viruses, or other harmful components.

We do not warrant that the results that may be obtained from the use of the Service will be accurate or reliable, or that the quality of any products, services, information, or other material purchased or obtained through the Service will meet your expectations.

7. Limitation of Liability

IN NO EVENT SHALL RECOIL GANG, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of or inability to access or use the Service.
• Any conduct or content of any third party on the Service.
• Any content obtained from the Service.
• Unauthorized access, use, or alteration of your transmissions or content.
• Any suspension, termination, or other action taken by any game publisher against your account as a result of using our Software.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT PAID BY YOU TO US FOR THE SERVICE.

8. Third-Party Games

Our Software is designed to work with certain third-party games. We do not claim any affiliation with, endorsement by, or association with the publishers of these games.

We strongly recommend that you use our Software responsibly and understand the risks involved.

9. Refund Policy

All sales are final and no refunds will be issued except in cases where the Software is demonstrably defective and cannot be repaired by our support team.

Refund requests must be submitted within 7 days of purchase and will be evaluated on a case-by-case basis. We reserve the right to deny any refund request at our sole discretion.

10. Digital Product Delivery and Payment Terms

Our products are delivered digitally as license keys that grant access to our software. By making a purchase, you acknowledge and agree to the following:

• License keys are delivered instantly after successful payment via email and are also accessible through your account dashboard.
• Our payment process is handled by secure, PCI-compliant payment processors. We do not store your full payment information on our servers.
• All prices are displayed in the currency indicated and include all applicable taxes.
• We reserve the right to change our prices at any time. Any price changes will not affect licenses already purchased.
• The customer is responsible for providing accurate payment and contact information. Delivery issues due to incorrect email addresses are not grounds for refunds.
• In case of payment disputes or chargebacks without valid reason, we reserve the right to suspend or terminate your license key and account without refund.

11. Indemnification

You agree to defend, indemnify, and hold harmless Recoil Gang and its licensees and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of:

• Your access to or use of the Service.
• Your violation of any term of these Terms.
• Your violation of any third-party right, including without limitation any copyright, property, or privacy right.
• Any claim that your use of the Service caused damage to a third party.

This defense and indemnification obligation will survive these Terms and your use of the Service.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of [Jurisdiction], without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
